NOTICE OF RULE-MAKING HEARING
NEBRASKA DEPARTMENT OF EDUCATION
NOTICE is hereby given that the Department of Education will hold a rule-making hearing on Wednesday, August 25, 2010, beginning at 10:00 a.m. (CT) The hearing will be on revisions to Title 92, Nebraska Administrative Code, Chapter 19, regulations regarding School Enrollment. The hearing will be conducted at the Nebraska State Office Building, State Board Meeting Room, 301 Centennial Mall South, Lincoln, Nebraska 68509.
The PURPOSE of the proposed revisions to Rule 19 is to incorporate revisions made to the enrollment statutes since the Rule was last revised in 2006. Major revisions include: adding a subsection to include that requiring proof by the child and/or enrolling parent that he or she is a citizen or lawfully admitted alien; addressing the issue of students under age 21 that seek enrollment but already possess some kind of diploma or certificate of completion from a foreign state, territory or country; adding a section that summarizes and references the open enrollment statutory provisions applicable to Learning Communities; adding language directly from the statute that requires part-time enrollment policies and procedures for students that attend private and exempt schools; and, adding informational language regarding foreign and foreign exchange student visas.
The FISCAL IMPACT statement may be obtained and inspected at the Office of the Nebraska Department of Education.
This hearing is being conducted under the provisions of Section 84-907 R.R.S., 1943, which provides that DRAFT COPIES OF THE PROPOSED RULES ARE AVAILABLE for public examination at the Nebraska Department of Education and at the Office of the Secretary of State, State Capitol Building, Lincoln, Nebraska. A copy of the hearing draft for this Rule is also available on the Nebraska Department of Education’s webpage at: http://www.education.ne.gov/legal/drafts.html
All INTERESTED PERSONS are invited to ATTEND and TESTIFY at the hearing. Interested persons may also submit written comments to the Nebraska Department of Education prior to the hearing, and those comments will be made a part of the hearing record at the time of the hearing.
